Discuss your circumstances

About this service

You can appeal a voivode's refusal of a temporary residence and work permit. Submit it to the Head of the Office for Foreigners through the voivode who issued the decision.

The appeal must be submitted within 14 days of the decision being delivered.

The appeal authority may uphold the refusal, grant the permit or return the case for reconsideration, depending on the findings.

Who it may suit

  • People who have received a first-instance residence refusal.
  • People who want help organising the decision, application documents and further evidence.

How we help

  • Review the decision and your application documents at a consultation.
  • Help you organise evidence relevant to the reasons for refusal.
  • Help prepare the appeal documents within the agreed scope.
  • Explain the submission steps and the matters that need an individual check.

Your next steps

  1. Bring the complete decision

Include its instructions and the envelope or electronic delivery information. We discuss the decision type and the next step.

  2. Review the reasons

We go through the refusal and the documents already submitted with you.

  3. Organise the response

We help you prepare the appeal information and supporting evidence within the agreed scope.

  4. Understand how to file

We explain the route stated in the decision and discuss how to keep evidence of submission. Preparing documents alone does not submit an appeal.

Good to know

  • These appeal instructions concern a first-instance temporary residence and work refusal, rather than every type of negative decision.
  • Residence appeals are submitted outside MOS, on paper or to the voivode's electronic delivery address.
  • For covered residence cases at voivodeship offices, decision time limits are suspended until 4 March 2027 and ordinary remedies for delay are restricted.
  • That suspension concerns decision time limits and does not suspend the applicant's deadline for appealing a refusal.
